JUSTICE SANJAY PRIYA ORAL ORDER 20-12-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Special (Excise) Case No. 421 of 2017 instituted for the offence under Section-30(A) of the Bihar Prohibition of the Excise Act, 2016.
It has been submitted that the petitioner is in custody since 27-09-2017.
In the prosecution report, it is alleged that police got confidential information that this petitioner is dealing in illicit liquor. Thereafter, police party reached and found one Pick up Van standing in front of house of this petitioner loaded with illicit liquor. One Dhanik Lal Yadav was found near the vehicle and he disclosed that the vehicle is standing since 25-09-2017 and this petitioner along with Bijendra Yadav got the vehicle parked in
Patna High Court Cr.Misc. No.56800 of 2017 (3) dt.20-12-2017 front of his house.
The police seized liquor from the Pick-up Van and prepared seizure list.
The seizure list is enclosed with the prosecution report which bears signature of Dhanik Lal Yadav and does not bear signature of this petitioner. There is no recovery of country made liquor from conscious possession of the petitioner. In such circumstances, prayer for bail is allowed. The petitioner named above is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each in connection with Special (Excise) Case No. 421 of 2017 to the satisfaction of learned Special Judge (Excise), Saharsa with condition that both the bailors should be close relatives of the petitioner.
