The petitioner is apprehending her arrest in connection with Fatuha P.S. Case No. 142 of 2018, registered for offences punishable under Sections 341, 323, 307, 452, 354 and 380 of the Indian Penal Code.
The complainant had filed a complaint case in the Court of Additional Chief Judicial Magistrate, Patna City, alleging therein complaint case no.1239/2017, which was referred to police under Section 156(3) Cr. P. C. , upon which, the FIR No.142/2018 under Sections 341, 323, 307, 452, 354 and 380 of the Indian Penal Code was instituted.
Patna High Court Cr.Misc. No.31388 of 2018 (2) dt.23-05-2018 2/2 Allegation against the petitioner is of causing head injury by Lathi on Pappu Shah. As per injury report, it is found that all injuries except injury no.1 was caused by sharp pointed object and bruise and scratch has been found on the body. Learned counsel for the petitioner submits that the petitioner is a lady and she has been falsely implicated in this case and the petitioner and complainant are Gotia. It is also submitted that all injuries are simple in nature and the petitioner has no criminal antecedent.
Considering the aforesaid fact, the petitioner, above named, in the event of her arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- ( Ten thousand) with two sureties of the like amount each in connection with Fatuha P.S. No. 142 of 2018 to the satisfaction of learned Smt. S. Rai, Judicial Magistrate, Ist Class, Patna City, subject to the condition laid down under Section 438 (2) of the Criminal Procedure Code.
