Earlier the prayer for bail of the petitioner was rejected with observation that he may renew his prayer for bail after framing of charge.
Submission of the learned counsel for the petitioner is that the charge has already been framed and except the circumstances and the fact that a petty coat and blood was recovered from the house of the petitioner, nothing has come against him and even the D.N.A. report is not available before this Court and he is in custody for more than one year. Heard learned A.P.P. also.
Having heard both sides and in view of facts and circumstances, at this stage, I am not inclined to grant bail to the
Patna High Court Cr.Misc. No.56005 of 2017 (2) dt.22-11-2017 2/2 petitioner, however, the learned trial court is directed to obtain D.N.A. report within a period of three weeks from the date of order and once the D.N.A. report is made available to the learned trial court, the petitioner will be at liberty to renew his prayer for bail before the learned trial court itself.
With the aforesaid observation, this application is disposed of.
