The petitioner apprehends his arrest in connection with Aurangabad Muffasil P.S. Case No.246 of 2022, registered for the offences punishable under Sections 147, 302 and 120(B) of the Indian Penal Code as well as under Section 27 of the Arms Act.

The case of the prosecution, in short, is that the father of the informant was shot dead by the named accused persons including the petitioner and 4-5 unknown persons. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the petitioner has got no criminal antecedents as stated in paragraph-3 of the bail application. It is further submitted that the allegation of firing

Patna High Court CR. MISC. No.71601 of 2022(2) dt.02-02-2023 2/2 upon the father of the informant is general and omnibus. The specific allegation of firing upon the father of the informant is against co-accused, Sunil Chandravanshi and Rahul Chandravanshi.

Learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioner. Considering the fact that no specific allegation is made against the petitioner, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Aurangabad Muffasil P.S. Case No.246 of 2022, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
