JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-06-2018 Petitioner apprehends his arrest in connection with Pandarak P.S.Case No. 147 of 2016 registered for the offences punishable under Sections 302/34 of the Indian Penal Code. Allegation against the petitioner is that he along with other accused persons has assaulted the father of informant, causing his death.

Submission of learned counsel for the petitioner is that post mortem report shows that there is no external injury on the person of deceased and further informant has filed a petition in the court of A.C.J.M., Barh that his father was suffering from illness and he fell down on earth and due to that he died. Heard learned APP also.

Having heard both sides and in the facts and

No.32427 of 2018 (2) dt.28-06-2018 2/2 circumstances, let the petitioner, named above, in the event of his arrest or surrender be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Barh, Patna, in connection with Pandarak P.S.Case No. 147 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions are that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
