The petitioner is apprehending his arrest in connection with Chauri P.S.Case No.5 of 2017 registered for offences punishable under Sections 304(B)/34 of the Indian Penal Code and Section 3⁄4 of the D.P. Act.

Petitioner is the husband and the case is of dowry death. Submission of the learned counsel for the petitioner is that she died of natural death at her Maike and the father-in-law was arrested. The trial was concluded with respect to father-in-law and he has been acquitted in that case.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant

Patna High Court Cr.Misc. No.32108 of 2018 (2) dt.28-06-2018 2/2 anticipatory bail to the petitioner rather let the petitioner surrender before the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below considering the fact that father-in-law was arrested and he has been acquitted.
