2. The petitioner seeks regular bail in connection with Narhiya P.S. Case No. 77 of 2025 for the offence registered under Sections 274, 275,3(5) of the BNS and Section 30 (a) of the Bihar Prohibition & Excise Act.
3. As per the prosecution case, total 108 litres of illicit Nepali liquor recovered from the motorcycle in possession of the petitioner.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He has no concern with the seized liquor or motorcycle. Nothing has been recovered from the conscious possession of the petitioner. He further submits that the petitioner was neither
Patna High Court CR. MISC. No.71427 of 2025(2) dt.08-10-2025 2/2 the driver nor the owner of the seized motorcycle. Petitioner is a young boy aged about 19 years, having clean antecedent. Petitioner is in jail custody since 24.08.2025. Petitioner undertakes to cooperate in the trial of the case.
5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case and the submissions of learned counsel for the parties and period of custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Jhanjharpur, Madhubani, in connection with Narhiya P.S. Case No. 77 of 2025.
