In this case, the petitioner is apprehending his arrest in connection with Laheria Sarai P.S. Case No. 81 of 2018 registered for offences under sections 413/414/467/471/34 of the Indian Penal Code.

The prosecution case is that the police had gone to the house of the petitioner to arrest him but, he was not available there, on search, a theft motorcycle was recovered. Learned counsel for the petitioner submits that the theft motorcycle was not standing at the Varanda of the petitioner rather it was kept in the Campus but, from the Case Dairy as well as the order-sheet, it reflects that the aforesaid motorcycle was recovered from the Varanda of the petitioner.

Looking to the entire facts and circumstances of the case as also the petitioner having criminal antecedent, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

Accordingly, the prayer for anticipatory bail of the petitioner, namely, Rahul Kumar Mandal is rejected. (Shivaji Pandey, J) rishi/- U T
