JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-10-2019 Petitioners seeks bail in anticipation of his arrest in connection with Rajoun P.S. Case No.144/2019 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 307, 325, 354, 504, 506 of the IPC.

As per FIR, the petitioners and other accused persons have assaulted the informant and his family members and there is specific allegation against the other co-accused of assault. Submission of learned counsel for the petitioners is that altogether twelve persons in the FIR but no specific allegation against these petitioners. There is land dispute between the parties.

Heard learned APP also.

In view of above facts and circumstances, let

Patna High Court CR. MISC. No.64912 of 2019(2) dt.17-10-2019 2/2 petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/-(Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka, in connection with Rajoun P.S. Case No.144/2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
