2. The petitioners are apprehending their arrest in Dagmara P.S. Case No. 29 of 2025 registered under Sections 126(2), 115(2), 117(2), 109, 76, 303(2), 352, 351(2) and 3, 3(5) of the BNS.

3. As per allegation, all the FIR named accused persons including these petitioners are said to have assaulted the informant on his head with iron rod. When his wife and son came to save him, they assaulted them and snatched the nose-pin of his wife.

4. It has been submitted on behalf of the petitioners that the petitioners are innocent and they have falsely been implicated in the present case. It has further been submitted that injuries inflicted upon

Patna High Court CR. MISC. No.73903 of 2025(3) dt.03-12-2025 2/2 injured injured persons are found to be simple in nature. The allegation against the petitioners are general and omnibus in nature. His further submission is that the injured person did not saw the persons who inflicted iron blow on his head. There is admitted land dispute between the parties.

5. Learned APP for the State opposed the prayer for anticipatory bail of the petitioners.

6. Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Birpur in connection with Dagmara P.S. Case No. 29 of 2025, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/ 482(2) of the BNSS, 2023.
