====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 29-01-2025 Heard Mr. Jitendra Prasad Singh, learned senior counsel for the petitioner and Mr. Shailendra Kumar, learned APP for the State.

2. The petitioner apprehends his arrest in connection with Sasaram (M) P.S. Case No. 295/ 2024 dated 04.07.2024 registered for the offence(s) punishable under Section(s) 108, 3(5) and 61(2) of the BNS.

3. The main submissions advanced by learned senior counsel for the petitioner are that the alleged offence of abetment to suicide is not made out against the petitioner in view of the allegations made in the FIR, as according to the informant, her deceased husband was in depression on account of non payment of the dues relating to the services provided by

No.74101 of 2024(3) dt.29-01-2025 2/3 the deceased as well as electrical articles having been supplied by him to several persons and the details of the 12 persons including the petitioner has been mentioned in the FIR, showing that they have outstanding dues on their part but the allegation as to non payment of the alleged dues cannot be deemed to be the direct reason for abetting the deceased to commit suicide, in fact, the deceased had purchased a Voltas AC machine from the shop of the petitioner's brother regarding which there was a dispute in between the deceased and the petitioner's brother and a case was also pending before the District Consumer Forum and the petitioner is a businessman having fair and clean antecedent.

4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.

5. Considering aforesaid submissions advanced by the petitioner's counsel and mainly taking into account the petitioner's fair and clean antecedent, this court is inclined to grant the relief of anticipatory bail to the petitioner. Accordingly, let the petitioner named-above, in the event of his arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail in connection with Sasaram (M) P.S. Case No. 295/ 2024 on

Patna High Court CR. MISC. No.74101 of 2024(3) dt.29-01-2025 3/3 furnishing bail bond of Rs. 20,000/-(Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned, subject to the conditions as laid down under Section 484(2) of the BNSS.
