====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 09-10-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks regular bail in connection with Birchkorwa P.S. Case No. 39 of 2024, registered for the offences punishable under Sections 103(1), 61(2), 238 and 3(5) of the B.N.S., 2023.
3. The petitioner is the husband of the deceased. He has been accused of torturing the deceased for demand of dowry and causing her death. He is in custody since 02.01.2025.
4. Learned counsel for the petitioner submits that the deceased and the petitioner have two children who are residing with the petitioner's family. It is further submitted that the deceased committed suicide and from the impugned order, it appears that no antemortem injury was found on the body of the

5. Learned A.P.P. for the State vehemently opposed the prayer for bail.
6. Considering the period of custody and the other materials, this application for regular bail is allowed.
7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-2nd, Jamui/ concerned Court below in connection with Bichkorwa P.S. Case No. 39 of 2024.
8. However, before accepting the bail bond, the court below shall verify whether the children of the deceased are in fact residing with the petitioner's family. In case the verification report is found to be otherwise, the bail bond shall not be accepted and the order of bail shall stand cancelled. (Sandeep Kumar, J) Neha/- U T
