The petitioner is in custody in connection with Puraini P.S. Case No.78 of 2017, a case under Sections 420/467/468/471 of the Indian Penal Code.

Allegation against the petitioner is that he sold the land of the informant in favour of co-accused Vijay Mehta. Even if the allegation is assumed to be correct, Vijay Mehta, who had purchased the land for consideration, has been cheated in the transaction and not the informant because no one can transfer a better title to anyone than he himself possess. Learned counsel for the informant opposed the

Patna High Court Cr.Misc. No.57994 of 2017 (3) dt.09-01-2018 P2/ prayer for bail.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Puraini P.S. Case No.78 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
