====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 09-10-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks regular bail in connection with Banjariya P.S. Case No. 108 of 2025, registered for the offences punishable under Sections 25(1-b)a, 25(g) and 26 of the Arms Act.

3. One country-made pistol and a live cartridge were recovered from one Vipul Raj. The name of the petitioner surfaced on the basis of the statement of the said Vipul Raj.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. It is further submitted that the petitioner is in custody since 30.07.2025, whereas Vipul Raj has already been granted bail.

5. Learned A.P.P. for the State vehemently opposed

6. Considering the nature of the allegations and the period of custody, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-F.C, Motihari, East Champaran/ concerned Court below in connection with Banjariya P.S. Case No. 108 of 2025 subject to the condition:- (i) The petitioner is directed to mark his attendance in Banjariya Police Station on every Sunday of each month. Failure to do so, will result in cancellation of bail bonds of the petitioner.
