The petitioner is accused in connection with Singhiya P.S. Case No. 57 of 2019 registered under sections 302, 307 and 120(B) of the I.P.C. pending in the Court of Additional Sessions Judge-I, Rosera, Samastipur. Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case due to village politics. Nothing incriminating has been recovered from the conscious possession of the petitioner. Further submission is that petitioner is in custody since 20.05.2019.

Learned A.P.P. appearing on behalf of the State

Patna High Court CR. MISC. No.64804 of 2019(2) dt.14-11-2019 2/2 opposed the prayer of the petitioner by contending that there is direct allegation against the petitioner of firing upon the brother of the informant with intention to kill him. The witnesses have also supported the prosecution version. The learned counsel appearing on behalf of the opposite parties also undertakes that the prosecution evidence will be concluded within three months. Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected.

However, liberty is given to the petitioner to renew his prayer for bail after three months.
