JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 773 of 2019, registered for the offences punishable under Sections 498A of the Indian Penal Code.

As per complaint case petitioner happens to be husband of the complainant and there is allegation of torturing the complainant with respect to demand of motorcycle. Submission of the learned counsel for the petitioner is that this case has been lodged after filing of divorce case No. 01 of 2019 before the Principal Judge, Family Court, Begusarai by the petitioner on the ground of desertion in which the complainant has already appeared and counseling is going on.

Having heard both sides, considering the facts that this case is related with marital dispute and as per petitioner both the parties appeared in the divorce case. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Five Thousand) with two sureties of the like amount to the satisfaction of learned Judicial Magistrate, 1st Class, Begusarai in connection with Complaint Case No.-773 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
