2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act.

3. The case of the prosecution is that from the newly constructed house of this petitioner altogether 560.34 liters of country made foreign liquor was recovered.

4. Learned counsel for the petitioner has submitted that the house of the petitioner is joint and nothing has been recovered from the possession of this petitioner. It has also been submitted that from perusal of the seizure list it will transpire that it does not bear signature of this petitioner. The petitioner was not apprehended on the spot. The petitioner is in custody

5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner and has submitted that the petitioner is having criminal antecedent of one case.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Isuapur P.S. Case No. 40 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise court no.3, Saran (Chapra).
