This is an application for grant of anticipatory bail in connection with Ganga Bridge P.S. Case No. 30 of 2017 registered for the offence punishable under Sections 302/34 of the Indian Penal Code.

The allegation of the informant is that the accused persons variously armed came and assaulted him and his wife resulting in death of the wife of the informant. The learned counsel for the petitioner refers to the post mortem report and submits that no external injury has been found on the person of the deceased, hence, the entire prosecution case appears to be concocted. No.58713 of 2017 (3) dt.16-01-2018 2/2 accused person, namely, Yogendra Rai has been granted anticipatory bail by this Court by an order dated 17.10.2017 passed in Criminal Miscellaneous No. 37531 of 2017 on the ground that the entire case appears to be doubtful. It is further submitted by the learned counsel for the petitioner that the petitioner has a clean antecedent.

Having regard to the facts and circumstances of the case, more particularly the fact that the co-accused person has already been granted anticipatory bail, I deem it fit and proper to enlarge the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Ganga Bridge P.S. Case No. 30 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
