The petitioners seek anticipatory bail in a case instituted for the offences under Section 420 of the Indian Penal Code. In the complaint petition allegation has been made that about Rs. 32,00,000/- was credited to the account of Shri Ashok Kumar @ Ashok Kumar Pal for the treatment of the family members with an undertaking to return the same. But when the money was not returned the present case has been filed. Learned counsel for the petitioner submits that there is no whisper against the petitioners to have taken the money from

Patna High Court Cr.Misc. No.36960 of 2018 (2) dt.29-06-2018 2 /2 the complainant and for the act of their family members, the petitioners should not suffer as the petitioner no.1 is mother and petitioner no.2 is brother of Ashok Kumar who is said to have taken the money.

Looking to the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today, let petitioners, namely, Saroj Devi and Pintu Kumar @ Alok Kumar Pal, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate - VI, Patna City in connection with Complaint Case No. 414 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
