2. The petitioner is apprehending his arrest in connection with Mahkar P.S. Case No. 118 of 2025 registered for the offence under Sections 137(2) and 140(3) of the B.N.S., lodged on 08.05.2025 by the informant, Manoj Manjhi.
3. As per the prosecution story, the informant alleged that his daughter went for coaching but failed to return. This led to the F.I.R.
4. Subsequent investigation took the case to the door of Rohit Kumar who is alleged to have connive with Shankar Manjhi and this petitioner in taking away the victim girl to Tamil Nadu, kept her there for one months and as per the statement of the victim girl, was repeatedly raped which has been supported by the medical examination of the girl.

5. Learned counsel for the petitioner submits that he is 19 years old, student, only because he has friendship with Rohit Kumar, got implicated. A vague allegation has been made that he alongwith Rohit Kumar and the victim went to the Station from where the girl was taken to Tamil Nadu by Rohit Kumar, if granted relief, shall be diligently appearing in trial and cooperating in the investigation.
6. Learned APP opposes the prayer submitting that though allegation of rape is on Rohit Kumar, the petitioner alongwith Shankar Manjhi facilitated Rohit Kumar in taking away the victim girl to Tamil Nadu.

Considering the submissions of the parties as also that the petitioner is a 19 years old boy, having no criminal antecedent, main allegation of taking the victim girl to Tamil Nadu is on Rohit Kumar, allegation of rape is also on them, in that background, this Court is inclined to extend him the privilege of anticipatory bail.
8. Let the petitioner be released on bail in the event of arrest or surrender within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV,

Case No. 118 of 2025 subject to the conditions as laid down under Section 438(2) of the Cr.P.C., as also with the following conditions:- (i) one of the bailor should be the family member/relative of the petitioner who shall provide official document to show his/her bona fide;
(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his/her bail bond by the Trial Court itself;
(iii) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(iv) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of bail bonds. (Rajiv Roy, J) vinayak/- U T
