JUSTICE RAKESH KUMAR ORAL ORDER 03-07-2018 Heard Sri Ram Sumiran Rai, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner, apprehending his arrest in connection with Teghra P.S. Case No. 110 of 2018, registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act , 2016, has prayed for grant of bail in the event of his arrest or surrender.

Learned counsel for the petitioner submits that in this case nothing was recovered from conscious possession of petitioner or from his premises or field , rather in this case recovery of Indian make foreign liquor was shown from the field of one Lal Babu Ray and petitioner has falsely been implicated in the present case. Learned counsel for the petitioner further submits that after petitioner was implicated in the

Patna High Court Cr.Misc. No.34864 of 2018(3) dt.03-07-2018 2/2 present case, he was subsequently, in the same manner, has been made accused in Teghra P.S. Case No. 152 of 2018. However, prior to lodging of the present case, petitioner was having clean antecedent.

Be that as it may, considering the nature of accusation as well as the fact that nothing was recovered from conscious possession of petitioner, in the event of his arrest or surrender within a period of six weeks from today, let petitioner Amardeep Rai be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge II cum Spl. Judge, Excise Court, Begusarai / concerned court in connection with Teghra P.S. Case No. 110 of 2018 subject to the conditions as contemplated under Section 438 (2) of the Code of Criminal Procedure, 1973.
