The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 392, 411 of the Indian Penal Code.

Prosecution case in nutshell is that the informant was going in his car (Reg. No. BR-01EW5688). He stopped near Bajaj Agency at NH-19 for nature's call, in the meantime, two miscreants on motorcycle, snatched four ATM cards, Pan Card, Rs 7,000/- cash, two mobile on the point of pistol and fled

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Petitioner is not named in the F.I.R. His name sprang up in this case on the basis of confessional statement of co-accused Ajay Kumar. Petitioner has not been put on T.I.P. Moreover, the petitioner is languishing in judicial custody since 6.8.2023.

In contra, learned APP appearing on behalf of the State vehemently opposed the prayer of the petitioner and submitted that the alleged looted car was recovered at the instance of the petitioner. During investigation, several witnesses have supported the prosecution case. Petitioner has 7 more criminal antecedents.

Having heard the learned counsel for the parties and considering the nature of allegation, this court is not inclined to enlarge the petitioner on bail and, as such, his prayer for bail stands rejected.
