The sole petitioner, apprehending his arrest in Manjhi P.S. Case No.89 of 2018 registered for the offence under Sections 272, 273, 188, 420 of the Indian Penal Code and Sections 30, 30(a), 38 of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail, in the event of his arrest or surrender, primarily on the ground that he has been made accused only on the basis of confessional statement of one of the co-accused, otherwise there is no other material to connect him. He also argued that in similar circumstances, two other coaccused, namely, Dhurendra Prasad Singh @ Dhuran Singh and Golu Singh have been extended the privilege of anticipatory bail
Patna High Court Cr.Misc. No.34208 of 2018(3) dt.28-06-2018 2/2 vide order dated 26.06.2018 passed in Cr.Misc.No.33088 of 2018.
Learned Addl. Public Prosecutor has opposed the prayer for grant of anticipatory bail, however he has not disputed the fact that other co-accused in similar circumstances have been extended the privilege of anticipatory bail. Accordingly, there is no reason to pass a different order in the present case. In the event of his arrest or surrender within a period of six weeks from today, let the petitioner, namely, Hari Bhushan Singh be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge VI-cum- Special Judge, Excise, Saran in connection with Manjhi P.S. Case No.89 of 2018, subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure.
