At the outset, it is submitted by the learned counsel for the petitioner that the instant application was filed for quashing of the first information report, during the pendency of the application investigation has come to an end and on receipt of the police report cognizance has also been taken by the Court of Special Judge.
In view of the submission made above, the application is dismissed as infructuous.
However, the petitioner would be at liberty to challenge the order of cognizance by way of filing an appropriate appeal
