JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Bihar P.S. Case No. 410 of 2019 registered for the offences punishable under Sections 419, 420/34 of the Indian Penal Code and Section 10 of Bihar Examination Act. As per FIR one co-accused was found to have appeared in the examination in place of the petitioner and he was apprehended by the authority.

Submission of learned counsel for the petitioner is that he was not present, which will appear from the FIR and he has falsely been implicated and he is a student. Heard learned APP also.

In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. However, if he surrenders and prays for regular bail,
