2. The petitioner seeks bail in connection with Raniganj P.S. Case No. 338 of 2023 instituted for the offences under Sections 302, 120B, 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. Prosecution case, in short, is that the accused persons, armed with weapons, reached the informant's house and knocked on the door, and as soon as the informant's son opened it, the petitioner fired at him, causing his death on the spot.

4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case due to dirty village politics. Learned counsel for the petitioner submits

Patna High Court CR. MISC. No.73955 of 2025(3) dt.02-12-2025 2/2 that general and omnibus allegation has been made against the petitioner. There is no independent witness to the present occurrence. It has been submitted on behalf of the petitioner that the petitioner is in custody since 22.08.2023 and has five criminal antecedents.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner stating that there is direct allegation against the petitioner of firing upon the deceased due to which he died on the spot.

6. As per the report dated 20.11.2025 sent by the learned court below, it appears that all the eight charge-sheeted witnesses have been examined.

7. Considering the aforesaid facts and circumstances of the case,there being direct allegation of firing upon the deceased against this petitioner also the trial being on the verge of conclusion, this Court is not inclined to grant bail to the petitioner at this stage.

8. Accordingly, the prayer for grant of bail to the petitioner is, hereby, rejected.
