2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 354B, 379, 307/34 and other allied sections of the Indian Penal Code.

3. As per the prosecution case, petitioner and other accused persons entered the house of the informant, abused him and damaged household articles and also abused and tore clothes of informant's bhabhi. They snatched her mangal sutra.

4. Learned counsel appearing for the petitioner submits that the parties are neighbours and because of dispute over pathway, this false case has been lodged against the petitioner.

5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner,

No.75498 of 2023(4) dt.09-04-2024 2/2 mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in Mehsi Police Station Case No. 69 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
