2. The petitioners have prayed for regular bail in a case registered for the offence punishable under section 30 (a) of the Bihar Prohibition and Excise Act.

3. The case of the prosecution is that three persons were allegedly seen carrying something in sacks. They were apprehended by the police and upon search altogether 34.740 liters of country made liquor was allegedly recovered.

4. Learned counsel for the petitioners submits that the petitioners are innocent and has falsely been implicated in

Patna High Court CR. MISC. No.70762 of 2025(2) dt.08-10-2025 2/2 connection with the present case. It is further submitted that nothing has been recovered from his conscious possession. It is further submitted that the police personnel had requested them to act as witnesses but upon their refusal, they have been falsely implicated in connection with the present case. Moreover, the petitioners are languishing in judicial custody since 23.08.2025 having no criminal antecedent.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Buxar Excise P.S. Case No. 327 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge Excise Court No. -II, Buxar. (Ashok Kumar Pandey, J) Jagdish/- U T
