This is an appeal under section 101(5) of the Juvenile Justice (Care and Protection of Children) Act, 2015 against refusal of the prayer for bail to the appellant by the order dated 21.10.2022 passed by Additional District & Sessions Judge Icum-Special Judge (SC &ST) Bettiah, West Champaran in Lauriya P.S. Case No. 34 of 2020 (Special Case No. 8 of 2022). Learned counsel for the appellant submits that the social investigation report mentions that the appellant has been implicated in this case on account of scuffle due to dispute regarding partition of land. On inquiry from the the neighbours, it was informed that the appellant was having good behaviour. The report lastly mentions that the appellant may be released on

Patna High Court CR. APP (SJ) No.4296 of 2022(4) dt.13-07-2023 2/2 bail. The appellant is in custody since 07.04.2022. Considering the submissions made about and the report of the probation officer, the appellant, above named, is directed to be released on bail on execution of surety bond by the brother-in-law of the appellant giving undertaking that he shall keep proper care and upkeep of the appellant. The impugned order is set aside and the appeal is allowed.
