The petitioner seeks anticipatory bail in a case instituted for the offences under Sections 328 and 304(B)/34 of the Indian Penal Code.

As per the First Information Report, the informant has received an information that the victim was suffering from loose motion and vomiting. When the informant and family members came there, they found her to be dead. Learned counsel for the petitioners submits that victim has died due to diarrhea. Sessions Judge has also not recorded the cause of death.

Looking to the facts and circumstances of the case, in the

Patna High Court Cr.Misc. No.37324 of 2018 (2) dt.04-07-2018 event of arrest or surrender within four weeks from today, let petitioners, namely, Kanti Devi and Neelam Devi, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate - 4th, Saran at Chapra in connection with Dariyapur P.S. Case No.78 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
