The petitioner is in custody since 24.08.2017 in connection with Barauni (Gadhara O.P) P.S. Case No. 437 of 2016 for the offence registered under Sections 413 and 414 of the Indian Penal Code and Section 7 of the Essential Commodities Act.

Learned counsel for the petitioner submits that the Pick-up Van had been seized was not having any material or stolen diesel from the Tanker and it was seized alongwith the Chaff (Bhusa). It is further submitted that though the vehicle was seized, the petitioner, subsequently, took release of the vehicle bearing Registration No. BR 09M-5347 and till that date, there was no allegation against the present petitioner. However, subsequently, on the basis of certain mischievous intervention by malicious persons, the name of the petitioner has been brought in.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Begusarai in connection with Barauni (Gadhara) P.S.
