The petitioners apprehend their arrest in a case registered for the offence under Sections 366A/34 of the Indian Penal Code and Section 8 of the POCSO Act.

Petitioners are alleged to have kidnapped the minor daughter of informant for the purpose of marriage. It is submitted on behalf of petitioners that the victim, in her statement recorded under Section 164 Cr.P.C., has denied the factum of kidnapping and stated that she was in love-affairs with Chandan Ram (petitioner no. 1) for the last two years and as such, after solemnizing marriage with him, she voluntarily went to Ludhiana with him. Petitioners claim clean antecedent.

Patna High Court CR. MISC. No.70867 of 2022(5) dt.11-07-2023 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the statement of the victim recorded under Section 164 Cr.P.C., let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge VI cum Special Judge, POCSO Act, Bettiah, West Champaran in connection with Nautan P.S. Case No. 351 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
