The present application has been filed for issuing a direction upon the respondent authorities to release the Vehicle (Car) of the petitioner bearing Registration No.- JH-01BN-6711 having Engine No.-K12MN1518909 and Chesis No.- MA3EHKD1S00811302 in favour of the petitioner, which was seized by the police official, Rohtas in connection with Dehir (T) (Indrapuri O.P) P.S. Case No.625 of 2021, which has been registered for the offences under Sections 337, 338 and 279 of

Patna High Court CR. WJC No.1815 of 2023(2) dt.08-05-2025 2/2 the Indian Penal Code.

3. It has been submitted by the learned counsel for the petitioner that the vehicle is lying with the authorities for about last three and half years and vehicle is in the process of decay and nothing will be left after a few years.

4. In view of the law laid down by the Hon'ble Supreme Court in the case of Sunderbhai Ambala Desai vs. State of Gujarat reported in (2002) Supp.(3) S.C.R.39, this application stands allowed.

5. It is directed that the vehicle should be released in favour of the petitioner after he furnishes the bond of Rs.50,000/- in the Court below.
