Aggrieved by judgment and order dated 04.09.2019 passed by learned Single Judge of this Hon'ble Court passed in C.W.J.C. No. 19118 of 2019 disposing of the writ petition in

Patna High Court L.P.A No.1269 of 2019 dt.02-03-2021 2/3 order to avail alternative remedy present L.P.A. has been filed by appellant/petitioner.

Appellant had filed writ petition for refund of Rs. 77,341.70/- alongwith interest which was deducted by respondent bank from his retiral dues.

Appellant was appointed in the Punjab National Bank on Class IV post and thereafter he was promoted to the post of Clerk and thereafter to the post of Head Cashier and was paid Head Cashier Allowance and he retired as Head Cashier on 31.05.2013. However, Rs. 77,341.70/- was deducted from the account of appellant, although there is no allegation of any fraud or misrepresentation by appellant in getting Head Cashier Allowance.

The writ petition was listed before the learned Single Judge upon mentioning for disposal of his representation dated 18.06.2013 and accordingly same was disposed of by the learned Single Judge with liberty to the appellant to approach the authorities having regard to the fact that the issues had been raised on his behalf before the Assistant Labour Commissioner which was still pending.

This Court does not find any infirmity or error in the order passed by the learned Single Judge requiring any
