JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-10-2019 This is an application for grant of anticipatory bail in connection with Bagan Gola P.S. Case No. 50 of 2019, disclosing offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

There is recovery of 24.4 liters of country made liquor from the Panchayat Bhawan and it is said that petitioner has kept the said liquor in the Panchayat Bhawan. Apart from that he is accused in one more case.

Submission of the learned counsel for the petitioner is that Panchayat Bhawan is not under the control of the petitioner. He has falsely been implicated in this case.

Heard learned A.P.P. also who has opposed the prayer for anticipatory bail on the ground that petitioner is named in the F.I.R. and apart from that he is accused in one more case

Having heard both sides, in view of the facts and circumstances, as stated above, this application is disposed of with a direction to the petitioner to surrender and pray for regular bail before the learned court below, the same shall be considered on its own merit, without being prejudiced by order of this Court, and if possible, to be disposed of on the same day.
