JUSTICE RAKESH KUMAR ORAL ORDER 29-06-2018 Heard Sri Sumit Kumar Jha, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner, apprehending his arrest in connection with Fatuha P.S. Case No. 593 of 2017, registered for the offence under Section 30(A) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender.
Learned counsel for the petitioner at the very outset has drawn my attention to the statement made in paragraph no. 3 of the petition and submits that petitioner is having clean antecedent. He further has drawn my attention to the F.I.R. and submits that in F.I.R. save and except suspicion, there is no other material to connect the petitioner in the present case. Besides hearing, I have perused the F.I.R. and after
Patna High Court Cr.Misc. No.37313 of 2018(2) dt.29-06-2018 2/2 going through the same, I am of the opinion that it is a fit case for grant of anticipatory bail. Accordingly, in the event of his arrest or surrender within a period of six weeks from today, let petitioner Rinku @ Dilip Kumar be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge ( Excise ) Patna / concerned court in connection with Fatuha P.S. Case No. 593 of 2017 subject to the conditions as contemplated under Section 438(2) of the Code of Criminal Procedure, 1973.
