2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30a of the Bihar Prohibition and Excise Act.
3. Prosecution case is that 20 liters liters illicit liquor has been recovered from possession of one Jitendra Ram.
4. Learned counsel appearing for the petitioner submits that no incriminating material has been recovered from the conscious possession of the petitioner and he has falsely been implicated in this case on suspicion. Petitioner's name has come in this case during course of investigation on the basis of confessional statement of co-accused. Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the prayer for bail.

6. Considering the facts of the case, this pre-arrest bail petition is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Bagaha, West Champaran in Ramnagar Police Station Case No. 341 of 2024, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
