The petitioner seeks bail in connection with Special Case No.04 of 2019, arising out of Vigilance P.S. Case No.03 of 2019, registered under Section 7(a) of the PC Act. The accusation is that the petitioner being the Junior Engineer of Rural Works Department demanded bribe of Rs.80,000/- for two construction works and to fill up the measurement book from the informant Manoj Kumar Singh. Thereafter, the informant Manoj Kumar Singh handed over the said amount to Gorelal Paswan, Assistant Engineer, Rural Works Department, and the same was handed over to the petitioner.

No.73609 of 2019(3) dt.17-03-2020 2/2 Learned counsel appearing on behalf of the petitioner submits that, admittedly, the bribe money was handed over to Gorelal Paswan, Assistant Engineer, Rural Works Department, which was handed over to the petitioner by him. Further submission is that, on verification, the charge-sheet was submitted against the petitioner and after framing of the charge, the informant has already been examined. The petitioner is in custody since 12.01.2019 and there is no chance for the petitioner to tamper with the evidence.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge Vigilance, Patna, in connection with Special Case No.04 of 2019, arising out of Vigilance P.S. Case No.03 of 2019.
