JUSTICE RAJIV ROY ORAL ORDER 10-02-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Banka P.S. Case No. 526 of 2022 for the offence registered under Sections 419, 420, 467, 468, 471 and 120B/34 of the Indian Penal Code and Section 25 (1-B)a, 26 and 35 of the Arms Act.

As per the prosecution story, the police upon information that Bhola Yadav and Alka Kumari after taking room on rent in Anurag Guest House are engaged in duping people on the pretext of helping them to get benefits of Government schemes like 'Pradhan Mantri Awas Yojna', 'Indira Awas', PDS dealer as also to provide job and further have engaged persons who don the uniform of police personnel.

Patna High Court CR. MISC. No.71726 of 2022(2) dt.10-02-2023 2/2 Accordingly, the said Anurag Guest House was raided and five persons were apprehended, all of whom were in police uniform. Two accused persons managed to escape, the petitioner being one of them. Further upon search, five seals of a political party President, fake identity card as also incriminating material were also recovered. The persons behind the said game, Bhola Yadav and Alka Kumari escaped. Accordingly, the FIR. In a guest house, an office was being run where innocent people were duped promising benefits of 'Pradhan Mantri Awas Yojna' and 'Indira Awas' and on providing jobs and further when the police reached there, the employees were in the police uniform, the petitioner being Manager of the said guest house having failed to take note of the fact and informed the police about the illegal activities and/or take corrective measures, no relief can be granted to him.
