The petitioner seeks bail in a case registered under Sections 447, 341, 323, 324, 354B, 379, 385, 504, 506/34 of the Indian Penal Code.
Allegedly, on the point of irrigating the field, the altercation took place between the parties and in consequence thereof, the accused persons assaulted the informant and his family members. There is also allegation of outrage modesty of wife of the informant by the accused persons. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The
Patna High Court CR. MISC. No.64495 of 2019(2) dt.17-10-2019 2/2 petitioner is in custody since 04-09-2019. Charge sheet has already been submitted. There is case and counter case between the parties. Free fight is alleged to have taken place between the parties. There is a land dispute between the parties. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 589 of 2018.
