====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 19-11-2019 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case for the offence registered under Sections 147, 148, 149, 341, 323, 504, 307 and 302 of the IPC.

The prosecution story, in brief, is that due to dispute of selling of illegal wine, when the informant was sitting, accused persons including the petitioner came at his house having armed with Lathi, Danda and told that why the informant objected in selling wine. They started quarreling between them and when the villagers came, the matter will be pacified. It is also alleged that again at about 3.00 P.M. when the informant was working in Khalihan, accused persons including the petitioner Sonu Manjhi having armed with Lathi, Danda came

No.68192 of 2019(2) dt.19-11-2019 2/3 there and assaulted him and on hearing alarm, when Rekha Devi, Sadabrichha Mochi, Runti Kumari, Surendra Manjhi, Dhuni Devi reached there to save him, accused persons also assaulted them, in which they also injured and his daughter Runti Kumari also sustained grievous injuries, and they have been treated in Danapur Hospital, but during course of treatment, his daughter Runti Kumari succumbed to his injuries. It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 30.07.2019. The petitioner has got no criminal antecedent. Charge sheet has been submitted in the present case. The petitioner has falsely been implicated in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. General and omnibus allegation has been made against the petitioner. Neither there is specific overt act is alleged against the petitioner nor there is specific injury is attributed against the petitioner.

On behalf of the State and the informant, it is submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of
