JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-12-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016 and Sections 20 and 22 of N.D.P.S. Act. Forty litres country-made liquor and 1 Kg 200 gram Ganja were recovered from a motorcycle. Petitioner and others were caught on spot.

Submission on behalf of the petitioner is that the seized motorcycle does not belong to the petitioner. Moreover, Salauddin Ansari having similar allegation has been granted privilege of bail by a Coordinate Bench of this Court. Considering the aforesaid facts and circumstances as

No.70953 of 2019(2) dt.04-12-2019 2/2 well as submissions of the parties and also taking note of the fact that the petitioner does not have any criminal antecedents, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, West Champaran at Bettiah in connection with Shikarpur P.S. Case No. 265/2019.
