JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-03-2023 Prayer for pre-arrest bail of petitioner no.2 has already been dismissed as withdrawn vide order dated 4.2.2023. Heard learned counsel for the petitioner no.1 and the State.

Petitioner no.1 apprehends arrest in a case registered for the offence punishable under sections 302/201/34 of the Indian Penal Code.

As per the prosecution case, petitioner and other accused persons killed informant's daughter and threw the dead body in the river.

Learned counsel for the petitioner no.1 submits that this petitioner happens to be mother-in-law of the deceased. She is innocent and has falsely been implicated in this case on suspicion as informant is not the eye witness of the occurrence and as a matter of fact, informant's daughter died due to sickness. Moreso, there is general and omnibus allegation against the petitioner and no specific overt act has been alleged against her.

In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in Barauni Police Station Case No. 428 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
