The petitioner apprehends his arrest in connection with Belhar P.S. Case No. 56 of 2017/Complaint Case No.626 kof 2018 registered for the offences punishable under Sections 323, 341, 354(A) and 379/34 of the Indian Penal Code. As per complaint, the prosecution case, in brief, is that on 27.03.2017 at about 5.00 pm. In the evening, the Maliyabin Marandi (complainant) was ret urning house from Basmata Hat (Bazar) ater purchasing some household articles and while she arrived in the way at lonely place near river, Ramesh Tanti (petitioner) stopped her and started abusing and molesting her

No. 65534 of 2019(2) dt.13-11-2019 2/3 and also t ook out purse holding of Rs.1200/- of complaint from her Blouse and thereafter the petitioner took out pistol from his waist and tried to outrage the modesty of the complainant and also abused by naming her caste. It is further alleged that the complainant raised alarm due to which one Munni Hembram and other public, who were coming from her behind ran towards the occurrence. In the meantime, the petitioner fled away by threatening the complainant that she will be killed, if she disclosed about the occurrence before anyone or the police. Learned counsel for the petitioner submits that the police filed the final form against the petitioner. Learned counsel for the petitioner further submits that the learned court has taken cognizance against the petitioner.

Learned counsel for the petitioner further submits that petitioner is the witness in the other case in which the informant has been made accused. In the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.III, Banka in connection with Belhar P.S. Case No. 56 of 2017/Complaint Case No.
