====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-12-2025 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.

3. As per prosecution case, this petitioner is alleged to be witness of the sale deed which was executed by one Rajit Kumar in favour of one Sita Ram Prasad with respect to the land of informant.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is innocent and has committed no offence. From bare perusal of the F.I.R. it is apparent that petitioner is only alleged to be witness of the alleged sale deed. Petitioner is not the beneficiary of the sale deed. Moreover, the dispute is with regard to sale and purchase

It is further submitted that similarly situated co-accused, namely, Ravi Kumar has already been granted anticipatory bail by this Court vide order dated 04.08.2025 passed in Cr. Misc. No. 47750 of 2025. Petitioner claims clean antecedents.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering backdrop of the case, nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge, II, Patna City, District- Patna in connection with Gaurichak P.S. Case No. 192 of 2024, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
