JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-10-2019 Petitioners seeks bail in anticipation of his arrest in connection with Piparia P.S. Case No.19/2019 registered for the offence punishable under Sections 379, 411/34 of the IPC and Section 4/40 of Bihar Minor Minerals Concession Rules, 1972 and Section 4/6/2 of Bihar Minor Minerals Prevention of Illegal Mining and Transportation and Storage Rule 2003 and Section 15 of Environment (Protection) Act, 1986.

As per FIR, allegation against the petitioners happens to be owner and driver of the trucks which was intercepted, loaded with sand.

Submission of learned counsel for the petitioner is

Patna High Court CR. MISC. No.64905 of 2019(2) dt.17-10-2019 2/2 that false and frivolous allegation is levelled against the petitioners and they are ready to abide by any condition if they are granted anticipatory bail and they have no criminal antecedent.

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/-(Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Lakhisarai, in connection with Piparia P.S. Case No.19/2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
