The petitioner has prayed for bail in a case registered for the offence punishable under sections 363, 366A,34 of the Indian Penal Code.

As per allegation in the FIR, petitioner in connivance with co-accused Aryan Kumar have kidnapped informant's daughter forcibly with bad intention.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. After recovery of the victim girl, her statement has got been recorded u/s 164 Cr.P.C. in which she has clearly stated that out of her own sweet will, she has left her house and she has not whispered the name of the petitioner. She has not made any

Patna High Court CR. MISC. No.71764 of 2022(3) dt.18-04-2023 2/2 allegation for physical abuse or assault to any one. There is no criminal antecedent on part of the petitioner. He is languishing in judicial custody since 11.8.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Bhojpur at Ara in connection with Ara Nawada P.S. Case No. 643 of 2022.
