In this case, the petitioners are seeking anticipatory bail in connection with Maner P.S. Case No.24 of 2018, registered for the offence punishable under Sections 379/411/34 of the Indian Penal Code, Section 4/40 of the Bihar Minor Mineral Concession Rules, 1972 and Sections 3/6 of the Bihar Mineral (Prevention of illegal Mining Transportation and Storage), Rules, 2003.
The police, on information, has gone to the village Mahavir Tola, from there seized the boat loaded with illegal sand. The petitioners are the owner of the boat as well as seller of the sand.
Patna High Court Cr.Misc. No.36620 of 2018(2) dt.29-06-2018 2/2 Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioners. Accordingly, the prayer for bail is rejected. However, if the petitioners surrender before the Court below within four weeks from today and pray for regular bail, the Court below will consider the same and pass appropriate order on the same day without being influenced by the order of this Court.
