Petitioner apprehends his arrest in connection with Complaint Case No. 2615(C) of 2012 lodged for the offences punishable under Section 406 of the Indian Penal Code. Earlier petitioner was granted privilege of anticipatory bail by learned Sessions Judge vide order dated 9.2.2015 passed in A.B.P. No. 2802 of 2015 with condition that he was to surrender within one month.

Submission of learned counsel for the petitioner is that petitioner could not surrender because he was suffering from paralytic attack and for that extension of time was sought but the

Patna High Court Cr.Misc. No.38931 of 2018 (2) dt.09-07-2018 2/2 same was rejected vide order dated 10.5.2018 passed in Cri. Misc. No. 25 of 2018.

Heard learned APP also.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, surrender within a period of four weeks from the receipt of this order and pray for regular bail, which shall be considered by learned court below keeping in view the fact that earlier petitioner was granted anticipatory bail by learned Sessions Judge and learned court below will pass an appropriate order, if possible, on the same day. With the above observation, this application is disposed of.
