JUSTICE MOHIT KUMAR SHAH ORAL ORDER 08-12-2023 The present petition has been filed by the petitioners for extending the time granted to them, vide order dated 21.07.2023, passed in Criminal Misc. No. 37243 of 2023, for surrendering before the learned court below and filing appropriate petition for grant of bail.

The learned counsel for the petitioners has submitted that on account of communication gap in between the advocate-on-record of the aforesaid case and the petitioners, the petitioners could not surrender and file appropriate petition for grant of bail, within the time frame prescribed by this Court by the aforesaid order dated 21.07.2023, hence, four weeks further

Patna High Court CR. MISC. No.80233 of 2023(2) dt.08-12-2023 2/2 time be granted for the purposes of surrendering before the Ld. Trial Court and filing appropriate petition for grant of bail. 3.

Having regard to the facts and circumstances of the case, considering the averments made in the present petition and taking into account the submissions advanced by the learned counsel for the petitioners, I deem it fit and proper to modify the order dated 21.07.2023, passed in Cr.Misc. No.37243 of 2023, by extending the time granted to the petitioners to surrender before the learned Court of Judicial Magistrate, 1st Class, Arwal in connection with Karpi P.S. Case No.38 of 2016 and filing appropriate petition for grant of bail, by a further period of four weeks from today.

The present petition stands disposed off with the aforesaid modification in the order dated 21.07.2023 passed in Criminal Misc. No.37243 of 2023.
